Marist Brother has indecent assault conviction quashed

02/02/2006 - 11:03:42
A former Marist brother has had his conviction for indecently assaulting six boys in a Sligo primary school quashed by the Court of Criminal Appeal.

The 63-year-old is now facing a retrial after his lawyers successfully appealed the conviction due to the antiquity of the charges and the fact that the trial judge did not adequately warn the jury about the dangers inherent in the delay.

The brother was found guilty on 180 counts of indecent assault by a jury in Sligo Circuit Court a year ago.

He was jailed for eight years for the offences, which the court heard took between 1968 and 1977.
