Dept insists new legislation closes speeding loophole

The Department of Transport has reportedly insisted that road traffic legislation introduced earlier this year closes the loophole regarding speeding offences that was exposed this week.

On Monday, the High Court ruled that the laser guns used by gardaí to check motorists’ speed were illegal under the previous legislation because they were unable to produce a permanent record of the speed detected.

The ruling raised doubts about thousands of speeding convictions in recent years and legal experts said there was uncertainty over whether the new legislation adequately addressed the situation.

However, reports this morning said the Department of Transport had insisted that the legislation which came into effect on January 20 had clarified the matter and that any speeding cases taken since then were legally sound.
