New York cop to sue over Big Mac 'with glass'

A New York policeman who was served a Big Mac stuffed with shards of glass is suing McDonald’s for $5.5m (€4.3m).

John Florio cut his mouth and throat and broke a tooth when he bit into the burger, allegedly cooked up by a teenager with a dislike of the police.

Albert Garcia, 18, was working behind the grill when he spied the officer approaching the drive-through and took the opportunity to strike, police said.

He was later arrested by an undercover officer who drove to the Bronx restaurant in a marked police car and spotted the worker spit in his food.

Florio, 41, is seeking damages in a negligence and reckless endangerment lawsuit against the fast-food chain, the restaurant where he ate and the worker.

The claim alleges that Garcia put “22 shards of razor-sharp glass” in the sauce on Florio’s Big Mac “for the sole purpose of inflicting severe bodily harm”.

It accuses the chain and franchisee of negligence for not properly supervising Garcia and seeks compensatory and punitive damages for “the wilful, knowing and intentional infliction of emotional distress and physical pain and suffering.”

The suit will be filed today at the Supreme Court in the Bronx.
