McAleese refers fees decision to Supreme Court
22/12/2004 - 12:43:11President Mary McAleese has referred the Government's new legislation on nursing home fees to the Supreme Court to test its constitutionality.
Mrs McAleese made the decision after seeking advice yesterday from the Council of State.
The new legislation legalises the practice of charging medical card holders for nursling home care.
Opposition parties have claimed retrospective provisions in the legislation are designed to block compensation claims from nursing home residents who were illegally charged in recent years.
